An Ordinance Establishing a Temporary Moratorium on Foreclosures due to Property Tax Increases as Long as the Owner is on a Payment Plan

Synopsis       This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance establishes a temporary moratorium on residential and  commercial foreclosures for properties whose FY ’26 tax bill increased by more than 25% compared to FY ’25 due to the recent reassessment by Tyler Technologies.  This will sunset September 30, 2026.

An Ordinance to Amend Chapter 34 of the City Code to Require Lead-Based Paint Inspections of Residential Rental Dwellings to comply with House Bill 70

Synopsis       This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Chapter 34 of the City Code to adopt, supplement, and enforce recently enacted State legislation that establishes a comprehensive framework for the reduction of lead-based paint hazards in rental properties in Delaware, including the City of Wilmington.  Specifically, House Substitute No. 2 for House Bill No. 70 (“HB70”), entitled An Act to Amend Titles 16 and 25 of The Delaware Code Relating to Lead-Based Paint, was recently signed into law.  Pursuant to HB70, all rental units constructed before January 1, 1978, must be certified as “lead free” or “lead safe” by a lead inspector approved by the Delaware Department of Health and Social Services.  This Ordinance enhances local enforcement of HB70 through the Department of Licenses and Inspections.  The full implementation of HB70 and its certification  requirements thereunder will not occur until all the necessary funding or regulations are in place, or March 1, 2028, at the latest.

A Resolution Approving the Members of the Reintegration Subcommittee and Authorizing a Modified Timeline for the Submission of a Preliminary and Final Report

Synopsis:        This Resolution is being presented by City Council for Council’s review and approval. In alignment with the Wilmington City Council 2022-2025 Strategic Plan priority of a “Stabilized Wilmington,” this Resolution approves the appointment of nine Wilmington residents to the Reintegration Subcommittee, a subcommittee of the Community Development and Urban Planning standing committee. It further authorizes a modified timeline for the submission of a final report to accommodate the appointment of the Reintegration Subcommittee members and the requirements associated with FOIA open meetings regulations.

An Ordinance Constituting Amendment No. 1 to the Fiscal Year 2026 Annual Operating Budget (Being an Ordinance to Amend Substitute No. 1 to Ordinance No. 25-009)

Synopsis       This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance is the first amendment to the Fiscal Year 2026 Annual Operating Budget, which was originally enacted in Substitute No. 1 to Ordinance No. 25-009. This Ordinance authorizes an increase in the Mayor’s Materials, Supplies, and Equipment General Fund appropriation of $425,000 to enable the City to hire consultants to assist the City in conducting interior assessments and validating Tyler Technologies’ mass appraisal reassessment model utilized for the recent real property reassessment conducted by New Castle County. It also authorizes a fund balance transfer of $75,000 from the Tax Stabilization Reserve to the Neighborhood Stabilization Fund to establish a grant program to provide financial assistance to low-income homeowners for filing appeals with the New Castle County Board of Assessment Review related to the real property reassessment.

An Ordinance to Authorize and Approve an Agreement Between the City of Wilmington and RingCentral, Inc. for a Communications Platform

Synopsis:        This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to enter into a five-year agreement with RingCentral, Inc. for a communications platform that unifies voice, video, messaging, and contact center services, with an option to extend the agreement for one (1) additional year.

An Ordinance to Amend Chapter 39 of the City Code to Allow Retired Police Officers to Serve on the Police Pension Board, as the Same is Permissible for the Fire Pension Board

Synopsis       This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance is being presented by City Council for Council’s review and approval.  This Ordinance amends Sections 39-152(a) and 39-216(a) of the City Code to permit both active and retired members of the Wilmington Police Department enrolled in either the Police Pension Fund or the City of Wilmington Police Pension Act of 1984 to run for the five (5) police officer positions on the board of trustees (the “Board”) that administers both plans.  It also provides a procedure for an active or retired police officer enrolled in either plan to place his or her name on the ballot, allows active and retired police officers enrolled in either plan to vote for the elected seats on the Board, and gives priority for the Board’s elected seats to be filled by active members enrolled in either plan.  (These same procedures are in place for the Fire Pension Board – see Sections 39-182 and 39-251.)

An Ordinance to Amend Chapter 44 of the City Code to Exempt from the City’s Earned Income Tax the Wages and Compensation Paid by the United States to any Person for Active Service in the Uniformed Services of the United States

Synopsis:        This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Section 44-106 of the City Code to exclude the wages and compensation earned by persons from active service in the uniformed services of the United States from the definition of “salaries, wages, commissions and other compensation” for purposes of the City’s earned income tax, rather than limiting the exemption to those in active service in the “armed forces.”

An Ordinance to Amend Chapter 2 of the City Code to Repeal the Defunct Wilmington Advisory Commission on Youth and Their Families and to Establish the Wilmington Youth Advisory Council Under the Auspices of City Council

Synopsis:        This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance establishes the Wilmington Youth Advisory Council under the auspices of City Council.  The primary objective of the Wilmington Youth Advisory Council will be to assist City Council in formulating a Youth Master Plan, the purpose of which is to promote the well-being and advancement of the City’s youth.  The Ordinance also eliminates the Wilmington Advisory Commission on Youth and Their Families, as this commission has been defunct since 2019.
