Synopsis: This Resolution is being presented by City Council for Council’s review and approval. In alignment with the 2022-2025 Wilmington City Council Strategic Plan goal of supporting a “Healthy Wilmington,” this Resolution approves grant funding to Duffy’s Hope, Inc. from City Council President Ernest “Trippi” Congo, II’s Community Support Discretionary Funds to purchase up to 2,500 turkeys that will be distributed to Wilmington’s high-rise residents and local community centers.

A Resolution Urging the Delaware General Assembly to Amend Title 22 of the Delaware Code by Repealing 22 Del . C . § 101A , which will Establish a Uniform Annexation Process for All Cities and Towns in Delaware (including Wilmington)
Synopsis: This Resolution is being presented by City Council for Council’s review and approval. This Resolution urges the Delaware General Assembly to amend Title 22 of the Delaware Code by repealing 22 Del. C. § 101A (Annexation by large municipalities; special elections), which only applies to the City of Wilmington, as it is the only municipality in Delaware with a population in excess of 50,000. The repeal of 22 Del. C. § 101A (Annexation by large municipalities; special elections) would establish a uniform annexation process for all cities and towns in Delaware, including the City of Wilmington, by subjecting all cities and towns to the same streamlined annexation procedures set forth in 22 Del. C. § 101 (Annexation by city or town).

A Resolution Urging the Delaware General Assembly to Amend Delaware Code Regarding Municipalities with Population of 50,000 or More Pertaining to Regulation of Liquor Stores
Synopsis: This Resolution is being presented by City Council for Council’s review and approval. This Resolution urges the Delaware General Assembly to enact legislation enabling municipalities with populations of 50,000 or more to pass ordinances more restrictive than state law regarding the placement of liquor stores. The proposed legislation would require the Alcoholic Beverage Control Commissioner of Delaware to deny licenses that violate these local ordinances. A draft proposed General Assembly bill is attached to the Resolution.

An Ordinance to Authorize and Approve an Agreement Between the City of Wilmington and LeadsOnline, LLC for an Integrated Ballistic Identification System
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to enter into a three-year agreement with LeadsOnline, LLC for an integrated ballistic identification system that is used to track and identify firearms by comparing digital images of unique marks left on bullets and shell casings.

An Ordinance to Amend Chapter 39 of the City Code to Allow Retired Police Officers to Serve on the Police Pension Board, as the Same is Permissible for the Fire Pension Board
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Sections 39-152(a) and 39-216(a) of the City Code to permit both active and retired members of the Wilmington Police Department enrolled in either the Police Pension Fund or the City of Wilmington Police Pension Act of 1984 to run for the five (5) police officer positions on the board of trustees (the “Board”) that administers both plans. It also provides a procedure for an active or retired police officer enrolled in either plan to place his or her name on the ballot, allows active and retired police officers enrolled in either plan to vote for the elected seats on the Board, and gives priority for the Board’s elected seats to be filled by active members enrolled in either plan. (These same procedures are in place for the Fire Pension Board – see Sections 39-182 and 39-251.)

An Ordinance to Amend Chapter 36 of the City to Clarify the City’s Loitering Definition
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends the City’s Loitering ordinance to clarify and narrow the scope of the conduct it prohibits and to expressly exclude from its application lawful and constitutionally protected conduct such as assembly, protest and a person’s involuntary unhoused status of persons in a public place.
