A Resolution to Amend Wilmington Charter Section 2-300 to Require City Council Approval to Appropriate Grant Funds in the Annual Operating Budget
Synopsis: This Resolution is being presented by City Council for Council’s review and approval. This Resolution initiates a proposed amendment to Wilmington City Charter Section 2-300 to require City Council approval to appropriate grant funds in the annual operating budget. In order for the Wilmington City Charter to be amended as proposed, three fourths (3/4) of all the members elected to Wilmington City Council must adopt this Resolution and two thirds (2/3) of all the members elected to the General Assembly must approve the proposed amendment.

An Ordinance to Amend Chapter 8 of the City Code to Create a Rental Assistance Program
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This ordinance creates a municipal low-income rental assistance program, to be administered by the Department of Real Estate and Housing, to provide eligible low-income residential tenants in the City of Wilmington up to $1,500.00 of monthly rental assistance, for a maximum of four (4) months in any given twelve (12) month period.

An Ordinance to Amend Chapter 2 of the City Code to Establish an Office of Community Safety
Synopsis: This Ordinance is being presented by the City Council for Council’s review and approval. This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance adds a new section under Chapter 2, Article V of the City Code and establishes a new office named the “Office of Community Safety” within the Mayor’s Office. The Office of Community Safety will address violence from both prevention and intervention perspectives by coordinating among government agencies, community organizations, and third party providers, identifying violence hotspots, and supporting and directing resources to at-risk populations, and carry out the long-term goal of the city government to reduce crime, restore social trust, and enhance public safety.

Synopsis: This Ordinance is being presented by the City Council for Council’s review and approval. This Ordinance amends Chapter 8 of the City Code by establishing housing trust, and a community-based oversight board, that is intended to help address the severe shortage of affordable housing in the city.

An Ordinance to Authorize and Approve an Electricity Procurement Contract Starting in Fiscal Year 2027
Synopsis: This Ordinance is being presented by the City Council for Council’s review and approval. This Ordinance authorizes the City to enter into one or more contracts for the purchase of electricity with one or more of three electricity providers starting in fiscal year 2027 for a term not to exceed five (5) years.

An Ordinance to Amend Chapter 40 of the City Code to Allow Employees to Donate an Unequal Amount of Accrued Sick and Vacation Leave to Designated Employees or to the Donated Leave Bank
Synopsis: This Ordinance is being presented by the City Council for Council’s review and approval. This Ordinance amends Chapter 40 of the City Code to allow regular City employees to donate unequal amounts of sick and vacation leave to designated employees or the donated leave bank. This Ordinance allows regular City employees to donate: 1) up to twenty (20) days of vacation leave per calendar year; or 2) up to 6 days of sick leave per calendar year without having to match with donated vacation leave. The Ordinance also permits regular City employees to donate in excess of 6 days of sick leave per calendar year, but such donations must be matched with an equal amount of donated vacation leave. This Ordinance has been influenced by similar amendments made to the Delaware Code in September 2017, and substantially mirrors the donated leave policies of other entities. This Ordinance is intended to make it easier and more convenient for regular City employees to donate accumulated sick and vacation leave to assist colleagues in times of need, thereby encouraging such donations. Finally, as housekeeping matters, this Ordinance adds some clarifying language to Sections 40-340(b) and (c) and changes the term “director of personnel” to “director of human resources” in Section 40-340(d).

An Ordinance to Amend Chapter 45 of the City Code to Empower the Commissioner of the Department of Licenses and Inspections to Issue Civil Penalties or Take Other Enforcement Action Against Cable, Telecommunication, and Other Utility Providers for Failing to Remediate Utility Wires
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance empowers the Department of Licenses and Inspections to document cable television, telecommunications, or similar utility wires and cables which impede the public right of way and to provide notice to the service providers responsible. The Department is further empowered to issue civil penalties to service providers or to take other reasonable steps to ensure the public right of way is clear of wires and cables in the event the service provider fails to take steps to eliminate the obstruction within 10 days of notice from the Department.

An Ordinance to Authorize and Approve the First Amendment to a Professional Services Agreement Between the City of Wilmington and Itron, Inc. for Mobile Automated Meter Reading Operations and System Maintenance to Transition from Automated Meter Reading to Advanced Metering Infrastructure
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to execute a first amendment to a professional services agreement with Itron, Inc. for mobile automated meter reading operations and system maintenance to transition from automated meter reading (AMR) to advanced metering infrastructure (AMI) for collection of water meter usage information from City water meters.

An Ordinance to Authorize and Approve a Network-As-A Service Agreement Between the City of Wilmington and Delmarva Power & Light Company
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to enter into a five-year Network-As-A Service Agreement with Delmarva Power & Light Company for the City and Itron, Inc. to use Delmarva’s Automated Metering Infrastructure Mesh Network to collect water meter usage information from City water meters. The Network-As-A-Service Agreement contains two (2) five-year extension options.

An Ordinance to Authorize and Approve the First Amendment to an Agreement for Water and Sewer Service Line Protection Programs Between the City of Wilmington and American Water Resources, LLC
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to execute a first amendment to an agreement with American Water Resources, LLC (“AWR”) that makes water and sewer line warranty protection services available to homeowners in the City. The amendment will (i) extend the duration of the agreement for five (5) years commencing on July 1, 2026 and ending on June 30, 2031 and (ii) cap the fees that AWR may charge homeowners for warranty protection services at $12.99 per month.
