A Resolution Requesting the Delaware General Assembly to Make Allowances for the City to Leevy an Excise Tax on Cigarettes Locally
Synopsis: This Resolution is being presented by City Council for Council’s review and approval. The Wilmington City Council 2022-2025 Strategic Plan envisions a “Healthy Wilmington,” by advocating for and enacting legislative measures to address preventable health threats. Tobacco-related illnesses contribute to more than 1,400 deaths annually in the State of Delaware and millions of dollars in public health expenditures. The City of Wilmington has the highest tobacco retail density in the State of Delaware, with as many as 18.32 retailers per 1000 people in some census tracts. This Resolution requests that the Delaware General Assembly make allowances for the City of Wilmington to levy an excise tax on cigarettes locally to prevent and reduce tobacco consumption.

An Ordinance to Amend Chapter 34 of the City Code to Provide for Residential Rent Stabilization
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Chapter 34 of the City Code by establishing residential rent stabilization policies. For non-exempt residential dwelling units, the authorized rent ceilings for rental units shall be determined by the current base payment standards established by the New Castle County Housing Authority. In addition, and subject to the ren ceiling provisions, the maximum percentage increase to rent in any 12-month period shall be the lesser of (a) three percent (3%) or (b) the 12-month average percentage change in the Consumer Price Index for all Urban Consumers, Philadelphia-Camden-Wilmington (All Items), as most recently published by the Bureau of Labor Statistics of the U.S. Department of Labor.

An Ordinance to Amend Chapter 40 of the City Code regarding Military Leave
Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Section 40-338 of the City Code regarding military leave to provide that an employee shall be entitled to a leave of absence not to exceed five years of cumulative service during the employee’s entire employment with the City regardless of the employee’s date of hire, consistent with the provisions of the Uniformed Services Employment and Reemployment Rights Act (“USERRA”). The terms of this Ordinance shall not apply to any bargaining unit employee, as such term is defined in Section 40-6 of the City Code, whose employment is governed by a collective bargaining agreement whose terms conflict with the provisions of this Ordinance.
