A Resolution in Support of HB No. 37 An Act to Amend Title 25 of the Delaware Code Relating to Landlord Obligations and Tenant Remedies

Synopsis:  This Resolution is being presented by City Council for Council’s review and approval.  This Resolution expresses support for the passage of House Bill No. 37, which aims to amend Title 25 of the Delaware Code relating to landlord   obligations and tenant  remedies.  House Bill No. 37 provides a framework for good faith negotiations and protections to both landlords and tenants when life-or health-threatening defects are present in a renter’s place of residence.

Synopsis:  This Resolution is being presented by City Council for Council’s review and approval.  This Resolution names appointments to a taskforce of City Council to be known as the Fines & Fees Taskforce that will be responsible for reviewing fees, fines, and administrative sanctions administered by the City, making findings, and, if the taskforce determines that changes are necessary, submitting recommendations to City Council.

A Resolution Regarding the Wilmington Police Department Commencing an Academy Class

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval.  In this Resolution, the City Council recognizes that the Chief of the Police Department has represented that the manpower of the Police Department has fallen below ninety-five percent (95%) of the number of police officers set forth in the position allocation list attached to the fiscal year 2023 annual operating budget ordinance and has drafted a resolution calling for the commencement of an academy class for the Police Department.

A Resolution Approving the Police Department’s Grant Application to the State of Delaware State Aid to Local Law Enforcement (SALLE) Program to Provide Advanced and Specialized Training to Officers

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval.  This Resolution authorizes the Wilmington Police Department’s grant application to the State of Delaware Department of Safety and Homeland Security for funding from the State Aid to Local Law Enforcement grant program in the amount of $60,202.00.  The proposed grant funding would be used to cover the cost of advanced and specialized training for police officers.  No local matching funds are required.

A Resolution Approving the Police Department’s Grant Application to the State of Delaware Emergency Illegal Drug Enforcement (EIDE) Program to Support Drug Investigations

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval.  This Resolution authorizes the Wilmington Police Department’s grant application to the State of Delaware Emergency Illegal Drug Enforcement program for $32,925.60 in grant funding, which would be used to support drug investigations.  No local matching funds are required.

Authorize and Approve the First Amendment to Contract 23008WDPS (Water Division Building/Raceway and Facilities Management and Maintenance Services) Between the City of Wilmington and Merit Construction Engineers, Inc.

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval.  This Ordinance authorizes the City to enter into the First Amendment to Contract 23008WDPS (Water Division Building/Raceway and Facilities Management and Maintenance Services) between the City of Wilmington and Merit Construction Engineers, Inc.  The amendment contains four (4) one-year extension options for the periods from July 1, 2023 through June 30, 2024 (“Fiscal Year 2024”), July 1, 2024 through June 30, 2025 (“Fiscal Year 2025”), July 1, 2025 through June 30, 2026 (“Fiscal Year 2026”), and July 1, 2026 through June 30, 2027 (“Fiscal Year 2027”).

Amend Chapter 4 of the City Code to Impose Civil Fines on Owners of Vacant Properties

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval.  This Ordinance makes the following amendments to Chapter 4 of the City Code: 1) changes the enforcement of Chapter 4 with respect to vacant buildings and structures from criminal enforcement to civil enforcement with civil fines for non-compliance; 2) removes imprisonment as a potential penalty in criminal enforcement proceedings; 3) provides that fines may be imposed for each week’s failure to correct violations rather than a daily fine; 4) sets forth requirements for the content and service of violations notices; 5) extends the time period in which to appeal a violation notice from 10 days to 20 calendar days; and 6) provides that the appeal fee shall be refunded if the appeal is successful.
